Acceptance of Terms

By registering for, accessing, or using the Servyn AI web application (available at servynai.in) or mobile application (Android / iOS), you ("User", "Customer", "Company") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are accepting these Terms on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms. If you do not agree, you must not use the platform.

These Terms apply to all users of the platform, including company administrators, managers, and field technicians.

Definitions

Account Registration

• You must provide accurate, complete, and current information during registration.
• Each company is allocated a single tenant account. You are responsible for all activity under that account.
• You must keep your login credentials confidential. Do not share your password with anyone.
• You must notify us immediately at founder@servynai.in if you suspect unauthorised access to your account.
• Servyn AI reserves the right to suspend accounts that show signs of unauthorised access or fraudulent activity.
• Each employee must have their own individual login. Sharing a single login across multiple people is not permitted.

Subscription Plans & Payment

• Access to the Platform beyond the trial period requires a paid subscription as per the pricing plans published on our website.
• Subscription fees are billed in advance for the chosen billing period (monthly or annual).
• All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.
• Failure to pay on the due date may result in suspension of access until payment is received.
• Refunds: All subscription payments are non-refundable. Please refer to our Refund & Cancellation Policy for complete details.
• Servyn AI reserves the right to change pricing with 30 days' prior notice to existing customers.

Trial & Demo Access

• Servyn AI may offer a free trial period of up to 7 days. No payment is required during the trial.
• Trial accounts are subject to our Trial & Demo Terms and Conditions.
• All data entered during the trial will be permanently deleted 7 days after the trial period ends, with a 3-day advance warning notification.
• No SLA or uptime guarantees apply during the trial period.
• Servyn AI reserves the right to modify, limit, or discontinue the trial offering at any time.

Acceptable Use

You agree not to use the Platform to:

• Violate any applicable Indian or international law or regulation
• Upload, store, or transmit unlawful, fraudulent, harmful, or offensive content
• Attempt to gain unauthorised access to any part of the Platform or another customer's data
• Reverse engineer, decompile, or attempt to extract the source code of the Platform
• Resell, sublicense, or white-label access to the Platform without written consent
• Use automated scripts or bots to scrape data or overload the Platform's servers
• Introduce malware, viruses, or any harmful code into the Platform
• Impersonate another user, company, or Servyn AI personnel

Violation of this section may result in immediate account suspension without refund. Please refer to our full Acceptable Use Policy.

Your Data & Multi-Tenancy

• You own your data. All Customer Data you enter into the Platform remains your property. Servyn AI claims no ownership over your operational data, customer records, or business information.
• Servyn AI is granted a limited, non-exclusive licence to process your data solely to provide the service to you.
• The Platform uses multi-tenant architecture. Each company's data is logically isolated and inaccessible to other companies on the Platform.
• You are responsible for the accuracy and legality of all data you enter into the Platform.
• Upon termination, you have 30 days to export your data. After that window, data is permanently deleted.
• Servyn AI employees do not access Customer Data except when required for support (with your consent) or when legally compelled.

Intellectual Property

• The Platform, including all software, code, design, user interface, logos, and brand assets, is the exclusive intellectual property of Servyn AI.
• You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for your internal business operations during the subscription period.
• You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Platform without our express written consent.
• Any feedback, suggestions, or feature requests you submit to us may be used by Servyn AI to improve the Platform without any obligation to you.

Third-Party Services

The Platform integrates with the following third-party services to deliver its functionality:

• Supabase — Database hosting
• Vercel — Application hosting
• Cloudinary — Media and file storage

Servyn AI is not responsible for the availability, performance, or actions of these third-party providers. We will make reasonable efforts to notify customers of any third-party service disruptions that affect the Platform.

Availability & Uptime

• We target a platform uptime of 99% for paid subscriptions, measured monthly.
• Scheduled maintenance will be communicated at least 24 hours in advance via email or in-app notification.
• Downtime caused by third-party infrastructure (Supabase, Vercel), force majeure, or circumstances outside our control does not count against our uptime target.
• No uptime guarantee applies to trial accounts.

Disclaimers

The Platform is provided on an "as is" and "as available" basis. Servyn AI does not warrant that:

• The Platform will be uninterrupted, error-free, or completely secure
• The Platform will meet every specific business requirement you may have
• Any errors will be corrected within a specific timeframe

Servyn AI is a software platform and does not provide legal, financial, tax, or compliance advice. Any reports or documents generated by the Platform should be verified by a qualified professional before being relied upon for legal or financial purposes.

Limitation of Liability

To the maximum extent permitted by Indian law:

• Servyn AI's total liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the total fees paid by you in the 3 months preceding the claim.
• Servyn AI shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption.
• Servyn AI shall not be liable for any loss or damage arising from your failure to keep your login credentials secure.

Indemnification

You agree to indemnify and hold harmless Servyn AI, its founders, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your violation of these Terms
• Your misuse of the Platform
• Inaccurate or unlawful data you enter into the Platform
• Any violation of applicable law by you or your employees

Termination

• By you: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refund is provided for the unused portion.
• By us: Servyn AI may suspend or terminate your account immediately for breach of these Terms, non-payment, or abuse of the Platform, with or without notice depending on the severity of the breach.
• Data after termination: You have 30 days from the termination date to export your data. After 30 days, all Customer Data is permanently deleted from our servers.
• Effect of termination: Upon termination, your licence to use the Platform ceases immediately. Sections 7 (Data), 8 (IP), 12 (Liability), 13 (Indemnification), and 15 (Governing Law) survive termination.

Governing Law & Disputes

• These Terms are governed by and construed in accordance with the laws of India.
• Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
• Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days' advance notice via email to the registered company admin and an in-app notification. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
